The two brothers accused of killing Shanon Wasserfall, a Walvis Bay resident, two years ago, will both deny all charges against them in the Windhoek High Court.

This information is in the pretrial documents that Steven Malundu, the defence lawyer representing Azaan Malundu, and Azaan Madisia have filed at High Court.

Madisia (30), and Malundu (24) won’t plead guilty to all charges. They will not make admissions to the charges and will reveal the basis of their defense to them during the trial.

It is also stated that they deny killing Wasserfall and transported her body from Walvis Bay to the location where it was buried.

Madisia, Malundu will be appearing before Christie Liebenberg in trial on February 6, 2023. The siblings were informed yesterday when they appeared before Liebenberg.

The trial is scheduled for the weeks of 6-10 Feb, 6-10 March, and 27-31 March.

Madisia Malundu and Wasserfall (21) were accused of murdering her at Walvis Bay on the 10th April 2020. They also robbed Wasserfall (21) by taking her a cellphone and watch, pair shoes, jacket, scarf, and jacket.

Madisia’s death is alleged to have occurred at Kuisebmond’s apartment. Madisia & Malundu used a vehicle to transport Wasserfall to an area near Walvis Bay’s Dunes Mall shopping centre. There they buried Wasserfall in shallow graves. The state has also filed indictments against the siblings.

Wasserfall was reported missing just one day after she was killed.

The police found her remains six months later.

After Madisia allegedly sent anonymous text messages via cellphone to Wasserfall’s father, and to police officers involved with the investigation into her disappearance, the remains were found 6 October 2020. The messages contained information that directed them to the location where Wasserfall’s body was buried.

Madisia, Malundu, and others are charged jointly with murder, robbery, with aggravating circumstances and defeating or obstructing justice.

Madisia alone is charged with two counts each of fraud and theft in connection to two false insurance claims she is alleged have filed with an insurance company between February 2020 and April 2020, and September to October 2020.

Madisia was detained in October 2020. Malundu was detained a month later. Both were taken into custody shortly after their arrests.

Tanya Klazen, Tanya Titus, and Albert Titus are legal aid lawyers representing Madisia (and Malundu).

Yesterday, the state was represented by Antonia verhoef (Deputy prosecutor General).
