\u201cYou live in a house which rests on land, and you will not live long without a house. So, land is life and without it you will die in a heavy storm, from extreme heat or at the merciless hands of diseases like malaria,\u201d said Dr. Geri Raimondo Legge, a Law Professor at the University of Juba.<\/p>\n

The academic spoke during a three-day consultative workshop held under the theme \u201cLand is Life\u201d in Juba. He may have also said that land matters matter a lot.\u00a0Like<\/em>\u00a0life: complicated affairs with uncertain outcomes.<\/p>\n

This is especially true in South Sudanese as a whole and Juba, the capital that has seen its population explode in recent decades.<\/p>\n

What do you do if there isn’t enough land or too many people are controlling it? How to deal with land ownership disputes when documentation is ambiguous or non-existent. What should you do if someone who fled armed conflict comes back to find that their former plot of land is now owned by another person?<\/p>\n

These and many other land-related problems were discussed by a broad range of stakeholders, including lawyers, state ministers, county commissioners, members of parliament, and county commissioners. The approximately 70 participants had been invited by the Civil Affairs Division and the Rule of Law Section of the United Nations Mission in South Sudan, in collaboration with the state\u2019s Land Commission.<\/p>\n

\u201cRespect of community land rights is critical to preserving our unity and social fabric and for peace to prevail. We fought because of greed and the unequal distribution of powers,\u201d Dr. Legge said, referring to South Sudan\u2019s long struggle for independence and highlighting the need to revise and enact laws to clarify matters of ownership and the allocation and use of land.<\/p>\n

Workshop participants demanded that the state government immediately establish a Law Review Commission at all levels to help them implement laws related town planning, land survey, and the registration plots. Dr. Legge said that this is a practice that could also be replicated in the nine other South Sudanese states.<\/p>\n

A special state land court was established to investigate land-grabbing crimes. This was another resolution reached by those present. The establishment of an independent land assessment and valuation body to calculate appropriate compensation for anyone forced into resettlement was also agreed upon.<\/p>\n

\u201cWe need concerted efforts to ensure that all discriminatory land management policies are addressed in a way that quells disputes over land,\u201d affirmed Emmanuel Adil Anthony, Governor of Central Equatoria State, who was pleased with the inclusiveness of another resolution reached: the explicit rights for women and people with special needs to acquire and own land in the state.<\/p>\n

The Governor also advised those in possession of land to make the most of it, for example by producing their own food and become \u201cthe masters of your own economy\u201d. He suggested that citizens lease their land to investors if small-scale farming is not feasible. This will allow them to reclaim the land if necessary.<\/p>\n

Flora Gabriel Modi, State Secretary of Land, Housing and Public Utilities, sees the workshop’s end as a sign that her ministry is about to begin.<\/p>\n

\u201cNow it is up to us to translate the outcomes here into action points, starting with the formulation of the necessary laws, passing them on to the State Council of Ministers for further deliberation and then forward them to the State Assembly for enactment,\u201d she said.<\/p>\n
